1. NAME OF THE PARTIES
The montecristoart.ro website (referred to as "site") is the property of Montecristo Art Studio SRL (referred to as "Administrator" or "Seller").
"Content" means all the information on the site that can be seen or accessed from a device that has an Internet connection.
"Order" represents the request through which a natural person, a commercial company or institution requests the delivery of a certain product, the execution of a work or the provision of a service.
"User" or "Buyer" means the person who accesses the content of the site.


2. TAX IDENTIFICATION DATA
Legal entity of Romanian nationality, with registered office in Popesti Leordeni, soseaua Oltenitei, no. 24, Floor 1, Apartment 6, Ilfov county, with order number in the Trade Register J23/3920/2020, unique tax registration code 42997246.

3. RIGHTS AND OBLIGATIONS OF THE USER
Access to the Seller's services is through the public website, available at www.montecristoart.ro.
By using the site, the user/buyer is responsible for all activities arising from its use. It is also responsible for any material, intellectual, electronic or any other damage that could be caused to the site, the administrator or any third party with whom it has concluded contracts, in accordance with the legislation in force.
The site is addressed to individuals who are at least 16 years old and to legal entities. The possibility to order online is available to people residing in Romania, and not only.
The user/buyer may not copy, transfer or use the content of this site regardless of its purpose or nature.


4. RIGHTS AND OBLIGATIONS OF THE SELLER
The administrator reserves the right not to respond to requests of any nature, which are related to the products/services presented on the website or to an order launched by a customer, received by any means of communication (electronic, phone call, SMS).
The administrator reserves the right to select the clients who have previously expressed their desire to receive newsletters and alerts to which they will send notifications, as well as the right to remove any client from their database without any further commitment on their part.
The Seller undertakes to ship the Goods and Services in a door-to-door courier system to the Buyer, with the exception of the case when the Buyer opts for personal pickup from the Seller's premises (Str. Drumul Cretestilor no. 96, Sector 4, Bucharest).
Transport – Packaging
If the Buyer opts for a different delivery method than those displayed on the website, the Seller does not assume and will not bear any moral or material damages.
The seller will ensure the appropriate packaging of the goods and will ensure the transmission of the accompanying documents.
The seller will deliver the goods on the territory of Romania.
In the case of products damaged as a result of transport, the Seller undertakes to replace the product or, as the case may be, to return to the Buyer the full or partial value of the purchased product. For more details on returns, visit the Return Policy page.


5. LIMITATION OF ADMINISTRATOR'S LIABILITY
The administrator is not responsible for the content, quality or nature of other sites reached through content links, regardless of the nature of these links. For the respective sites, the responsibility is fully borne by their owners. Also, the seller does not offer direct or indirect guarantees that the service will be according to the Buyer's requirements, the service will be uninterrupted or without errors of any kind or that the products or services obtained through this site will correspond to the Buyer's requirements or expectations.
The administrator fully assumes the responsibility to realize / offer, based on the order, the products / services exactly as they were requested by the user.
In the case of personalized products, the Administrator does NOT assume responsibility for products made incorrectly or erroneously, in the following situations:
When the files sent to be printed were incorrectly edited by the user (erroneous contact data, spelling mistakes, etc.), and printed as such;
When the materials were personalized erroneously, and the user sent the Type Good to the Administrators exactly in the format in which they were made;
When the information placed on the personalized materials was erroneously transmitted by the user, through the online order form or by e-mail;
When the quality of the printed images is unsatisfactory, and the files sent by the user do not comply with the technical requirements recommended by the administrator;
When the color accuracy is unsatisfactory, and the user sent the files in one of the color models that do not comply with the technical requirements recommended by the administrator.


6. BILLING AND PAYMENT POLICY
The price, payment method and payment term are specified in the Order. The Seller will issue an invoice to the Buyer for the goods and services delivered, the Buyer's obligation being to provide all the information necessary to issue the invoice, in accordance with the legislation in force.
Payment can be made in three ways:
Refund, upon delivery of the products.
Payment with payment order. Payment will be made in full in advance, based on the invoice, issued immediately after confirming the order.
Online payment by card, at the time of placing the order.


7. WARRANTIES
If the Administrator cannot honor an order for various reasons, he will inform the Client about this unavailability, on the date when the Administrator becomes aware of this case. In the event that the product has already been paid for by the Buyer, the amounts paid will be reimbursed by the Seller within a maximum of 14 calendar days, according to art. 11 paragraph 2 of Law 130/2000 regarding the execution of distance contracts.
In the event that the delivery deadline is exceeded, Fainart.ro will inform the Buyer by phone or e-mail and will agree with him to extend the delivery deadline by a period that will not exceed the initially stipulated delivery deadline. If, within the new mutually agreed period, the product will be unavailable for delivery, the Customer can request the termination of the remote contract and the cancellation of the order. The buyer has at his disposal a term of 3 working days from the date of issuing the information notice to express his option regarding the ordered product. The lack of receipt by Fainart.ro of a response from the Buyer within the specified term, will be considered as his tacit acceptance for the extension of the delivery period.


8. COMPLAINTS
Any complaint is resolved within a maximum of 15 working days, from the date of its transmission by email: contact@montecristoart.ro.


9. CONFIDENTIALITY
The administrator undertakes to protect, in safe conditions, the personal data provided by the user/buyer.
The processing of personal data is applied according to Regulation (EU) 2016/679 ("General Data Protection Regulation" or "GDPR"), as well as any other applicable legislation in Romania.

10. CHANGES
The administrator reserves the right to modify the content of the site without notifying the users beforehand.
